Warranty conditions

The warranty only applies to normal use of the equipment. Any return of equipment must first be accepted by LPS FRANCE – GROUPE CEMASO . Our liability is limited to the sole starting value of the parts supplied and recognized as defective without being required to pay any other compensation to the buyer such as the costs of dismantling, reassembly, diagnosis, expertise, loss of use, or other expenses. It is specified that the company LPS FRANCE – GROUPE CEMASO cannot be held responsible for damage caused, directly or indirectly, by the equipment it has at the customer's premises, whether this equipment is defective or not.

2 - Proof of purchase and/or certificate of authenticity

Regardless of the type of guarantee concerned, it will be valid if at least one of the following documents is presented:

  • The product purchase invoice issued by LPS France
  • The certificate of authenticity and legal guarantee of conformity obtained following registration of the product in the LPS Manager* application.

3 - Warranty start date

Regardless of the type of warranty concerned, it begins on the date of the product purchase invoice from LPS France .

4 - Application area

Our guarantees are valid internationally without geographical restrictions.

5- Specific conditions for each type of guarantee

5.1 Legal guarantee of conformity

Our products being manufactured in France, they are guaranteed for 2 years under the guarantee of conformity (articles L217-4 et seq. of the Consumer Code) and the guarantee of hidden defects (article 1641 et seq. of the Civil Code) (see . legal provisions in appendix).

5.2 LPS France commercial guarantee
5.2.1 Use, installation, use and maintenance

The LPS France commercial warranty is subject to product registration in the LPS Manager application (lpsmanager.io).

Any owner of products from the company LPS FRANCE – GROUPE CEMASO can take advantage of the extended warranty provided that the said product has remained on the site where it was initially installed.

This warranty applies only under normal and proper use, installation, use and maintenance, and only when the products are subject to ordinary conditions of use.

It does not apply:

  • in the event of non-compliance with the NFC 17-102:2011 and IEC 62-305 standards in force in terms of risk assessment, design, installation, verifications, maintenance
  • more generally if the product could not be stored or used or installed in accordance with the recommended specifications and procedures,
  • in the event of damage caused by third parties or other events, accidents resulting from abnormal use of the products over which we have no influence, or repairs carried out by unauthorized operators.
  • if the product identifier or serial number has been changed, removed or made illegible, or is not readable for any other reason.

Simple changes to the external appearance of the product which do not affect its technical function do not constitute defects.

Returns are limited only to parts in perfect salable condition, which means unassembled.

5.2.2 Compensation – liability

When the warranty claim is admissible and recognized as justified, the company LPS FRANCE – GROUPE CEMASO may, as it sees fit, repair or replace the non-compliant or deficient products for which it is responsible or alternatively reimburse the price of purchase to the buyer.

If the type of product under warranty is no longer manufactured at the time of the failure incident covered by the warranty, we reserve the
right to deliver another type of product (size, shape, color, and/or different characteristics).

It is up to LPS France - Groupe CEMASO to freely choose the type of compensation granted under the guarantee, taking into account the circumstances specific to each case and the legitimate interests of the buyer.

The products exchanged become the property of the company LPS France – Groupe CEMASO .

The liability of the company LPS FRANCE – GROUPE CEMASO is limited to the sole starting value of the parts supplied and recognized as defective, without being required to pay any other compensation to the buyer such as the costs of dismantling, reassembly, diagnosis, expertise, loss usage, or other expenses.

The warranty does not cover periodic checks, maintenance, repair and replacement of parts due to normal wear and tear.

Any return of equipment must first be accepted by LPS FRANCE – GROUPE CEMASO .

Return costs remain the responsibility of the customer.

It is specified that the company LPS FRANCE – GROUPE CEMASO cannot be held responsible for damage caused, directly or indirectly, by the equipment, whether defective or not.

Thus, the company LPS FRANCE – GROUPE CEMASO cannot be held responsible for a loss of activity or profit, period of inactivity or
delay, labor, repair, material or other loss or damage incurred by the buyer.

5.3 Warranty extensions

These offers are available at the customer's request and are the subject of a contract signed by him which constitutes acceptance of the guarantee conditions contained therein.

Appendix: Reproduction of the legal provisions concerning the guarantee of conformity

“The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

“When the contract of sale of the good provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee is applicable to this digital content or this digital service throughout the period. the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date of its appearance.

“The consumer can obtain a reduction in the purchase price by keeping the goods or end the contract by being reimbursed in full against return of the goods, if:

“1° The professional refuses to repair or replace the goods;

“2° The repair or replacement of the goods takes place after a period of thirty days;

“3° The repair or replacement of the good causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-compliant good, or if he bears the costs of installing the repaired good or replacement;

“4° The non-compliance of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

“The consumer also has the right to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies the reduction in the price or the termination of the contract being immediate. The consumer is then not required to request repair or replacement of the goods beforehand.

“The consumer does not have the right to cancel the sale if the lack of conformity is minor.

“Any period of immobilization of the good for its repair or replacement suspends the guarantee which remained to run until the delivery of the restored good.

“The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.

“The seller who obstructs in bad faith the implementation of the legal guarantee of conformity incurs a civil fine of a maximum amount of 300,000 euros, which can be increased up to 10% of the average annual turnover (article L. 241-5 of the Consumer Code).

“The consumer also benefits from the legal guarantee against hidden defects in application of articles 1641 to 1649 of the civil code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the item is kept or to a full refund against return of the item. »
