Warranty conditions

The warranty is valid only under normal use of the equipment. All equipment returns must be approved in advance by LPS FRANCE – GROUPE CEMASO. Our liability is limited to the initial value of the parts supplied and acknowledged to be defective, without any further compensation to the buyer, such as dismantling, reassembly, diagnostic, expert assessment costs, loss of use, or other expenses. It is specified that LPS FRANCE – GROUPE CEMASO cannot be held liable for damages caused, directly or indirectly, by the equipment it has in its possession at the customer's premises, whether that equipment is defective or not.

2 - Proof of purchase and/or certificate of authenticity

Regardless of the type of guarantee concerned, it will be valid if at least one of the following documents is presented:

  • The product purchase invoice issued by LPS France
  • The certificate of authenticity and legal guarantee of conformity obtained after registration of the product in the LPS Manager application*.

3 - Warranty start date

Regardless of the type of warranty concerned, it begins on the date of the invoice for the purchase of the product from LPS France.

4 - Scope of application

Our guarantees are valid internationally without geographical restrictions.

5- Specific conditions for each type of warranty

5.1 Legal guarantee of conformity

Our products are manufactured in France and are guaranteed for 2 years under the guarantee of conformity (articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (article 1641 et seq. of the Civil Code) (see legal provisions in the appendix).

5.2 LPS France Commercial Guarantee
5.2.1 Use, installation, operation and maintenance

LPS France commercial warranty is subject to product registration in the LPS Manager application ( lpsmanager.io ).

Any owner of products from the company LPS FRANCE – GROUPE CEMASO can claim the extended warranty provided that the said product has remained on the site where it was initially installed.

This warranty applies only under normal and proper use, installation, operation and maintenance, and only when the products are subject to ordinary conditions of use.

It does not apply:

  • in the event of non-compliance with the applicable NFC 17-102:2011 and IEC 62-305 standards regarding risk assessment, design, installation, verification, and maintenance
  • More generally, if the product could not be stored, used, or installed in accordance with the recommended specifications and procedures,
  • in the event of damage caused by third parties or other events, accidents resulting from abnormal use of the products and over which we have no influence, or repairs carried out by unauthorized operators.
  • if the product's identification number or serial number has been changed, removed, or rendered illegible, or is otherwise illegible.

Simple changes to the external appearance of the product that do not affect its technical function do not constitute defects.

Returns are limited to parts in perfect condition for resale, meaning unassembled.

5.2.2 Compensation - Liability

When the warranty claim is admissible and recognized as valid, LPS FRANCE – GROUPE CEMASO may, as it sees fit, repair or replace non-compliant or defective products for which it is responsible or alternatively refund the purchase price to the buyer.

If the type of product under warranty is no longer manufactured at the time of the failure incident covered by the warranty, we reserve the
right to deliver another type of product (different size, shape, color, and/or features).

It is up to LPS France-Groupe CEMASO to freely choose the type of compensation granted under the guarantee, taking into account the specific circumstances of each case and the legitimate interests of the buyer.

The exchanged products become the property of the company LPS France – Groupe CEMASO.

The liability of LPS FRANCE – GROUPE CEMASO is limited to the starting value of the parts supplied and recognized as defective, without being liable for any other compensation to the buyer such as the costs of dismantling, reassembly, diagnosis, expertise, loss of use, or other expenses.

The warranty does not cover periodic checks, maintenance, repair and replacement of parts due to normal wear and tear.

All returns of equipment must be accepted in advance by LPS FRANCE – GROUPE CEMASO.

Return shipping costs are the responsibility of the customer.

It is specified that the company LPS FRANCE – GROUPE CEMASO cannot be held responsible for damages caused, directly or indirectly, by the equipment, whether defective or not.

Therefore, LPS FRANCE – GROUPE CEMASO cannot be held responsible for any loss of business or profit, period of inactivity or
delay, labor costs, repair costs, material costs or any other loss or damage that may be suffered by the buyer.

5.3 Warranty Extensions

These offers are available at the customer's request and are subject to a contract signed by the customer, which constitutes acceptance of the warranty conditions contained therein.

Appendix: Reproduction of the legal provisions concerning the guarantee of conformity

"The consumer has two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.".

"When the sales contract for goods provides for the continuous provision of digital content or a digital service for a period exceeding two years, the legal guarantee applies to that digital content or digital service throughout the entire provision period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it appeared.".

"The consumer can obtain a reduction in the purchase price by keeping the goods or terminate the contract by receiving a full refund upon return of the goods, if:"

"1° The professional refuses to repair or replace the item;

"2° The repair or replacement of the property takes place after a period of thirty days;

"3° The repair or replacement of the goods causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-compliant goods, or if he bears the costs of installing the repaired or replacement goods;

"4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

"The consumer is also entitled to a price reduction or cancellation of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or cancellation. The consumer is not then required to request the repair or replacement of the goods beforehand.".

"The consumer is not entitled to rescind the sale if the lack of conformity is minor.

"Any period of immobilization of the asset for the purpose of its repair or replacement suspends the warranty which remained to run until the delivery of the repaired asset.

"The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.

"A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased up to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).

"The consumer also benefits from the legal guarantee against hidden defects, pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund upon return of the goods."
